Can a myspace user post a unauthorized photo of your child on their private myspace profile?

My ex-husband's ex-girlfriend and her daughter both have myspace profiles. The "front" photo on both pages is of my children and her children. Neither she nor her daughter have any relationship with my children; legally or otherwise. I have contacted myspace about having the pictures removed as I do not have access to either page to monitor the information on them. Myspace tells me that they will only delete the pictures where my children are "unsupervised" in the photo. So basically, on myspace you can use any child's picture as long as there is an adult in the photo? What can I do to get the content off? Any advice is appreciated. My ex-husband, who does not have internet access at all, feels it is no big deal. I, however, disagree. I think any child whose photo is on the internet needs to be closely monitored by a parent. Thanks!

well i would be mental if it was my kids i would contact myspace and threaten them with legal action if the don't remove your kids photos

You should go over to her house and talk to her, if she dosent take them off then thretan her with the police and solicitors etc

There is no way to remove the photos, as your ex-husband's ex-girlfriend does have her children in the photo as well, and so she has rights to the photo.



Additionally, I don't think you have to worry. I understand you're a worried and watchful mother, and that's good, but the internet isn't as scary as people make it out to be.



If your children's photos had an address on it, then you should worry. But if it's just a photo of them, then you have nothing to worry about. Nobody on the internet is going to go through the trouble of looking at the photo and doing extensive research to find your kids. Nobody is that crazy nor desperate.

i dont know the laws governing this, but i do agree with you. i think if you wish your children's pics to be taken down, then your ex should respect you as their mother for pete sakes.



this sounds like a candidate for a legal consultation. (if they have the profile or pics set to private, you may have some trouble getting them removed, i just dont know). anyway, good luck!

Yeah, my sons deadbeat father took a picture of my son and put it on his myspace. Fortunately, he deleted it and I deleted him as well.

Unfortunately, there isn't much legaly you can do. If they have the photo, they are free to post it wherever and whenever they want to. To draw a paralell, and I know this is a stretch but its like the paprazzi taking a picture of a celebrity and posting it in a magazine article.
